Healthy Homes Deadlines
As of 1 July 2021, all private landlords must ensure their rental properties comply with the Healthy Homes Standards within 90 days of any tenancy commencing or being renewed. All existing periodic tenancies will have until 1 July 2024 to comply but the Barfoot & Thompson property management team are working with our landlords to make all the properties we manage compliant as soon as possible.
Here's some additional information to better understand this deadline :
- The deadline to comply with the Healthy Homes Standards requirements after 1 July 2021 is based on the commencement date of the tenancy, not the signature of the agreement or renewal document. This means that any tenancy that starts or is renewed after 1 July 2021 will have 90 days from the commencement or renewal date to comply. Signing an agreement before 1 July 2021 for a tenancy that starts after 1 July 2021 will not get around the requirement to comply. Use this link to refer to the relevant legislation.
- Any tenancy which is signed, commences, renewed or varied also needs to have a section 13a statement given to tenants with their tenancy agreement, renewal, or variation document. This statement must include certain information about the property’s current level of compliance with the standards. A fixed-term which started before 1 July 2021 but rolls to a periodic tenancy after that date is NOT a variation and doesn’t trigger the requirement to provide a statement, and the property will need to comply by 1 July 2024 assuming the same tenancy does not end.
- Any fixed-term tenancies signed and starting before 1 July 2021 will be required to provide a statement at the time the fixed-term tenancy is renewed. The compliance date for these tenancies will be 90 days after their renewal date (for example, if a fixed-term tenancy started on 1 February 2021 and is renewed on 1 February 2022, it would need to have a statement sent to tenants with the renewal document and will have 90 days from 1 February 2022 to comply.
